Conservative Supreme Court Justices' View on our Right to Vote is Shocking!

Conservative Supreme Court justices “expressed skepticism Wednesday about whether the federal government should still be requiring preclearance of voting system change in certain places with a history of racial discrimination in elections. Conservative Justice Antonin Scalia even went so far as to condemn Section 5 of the Voting Rights Act as a “perpetuation of racial entitlement”(!?!?!)  (huffingtonpost.com)

A right “conforms with  justice, law or morality”.  (Webster’s Dictionary)

An entitlement “furnishes a claim to something”.  (Webster’s Dictionary)


As we all know, “entitlement” is the Tea Partied Republican code word for "I see Black people!!!!" regarding any   government-subsidized program  including Social Security, Medicare,  and Medicaid irrespective of  the facts that  1) the comparison of race to entitlements is a common GOP race baiting  "fallacy" (root.com) and 2) entitlement programs “largely support people that have moreover contributed to the system in satisfactory faith.” (over50web.net)


Why a Supreme Court Justice would minimize and politicize the Constitutional right to vote following the nationwide Jim Crow tactics surrounding Election 2012 is beyond belief!


The non-politicized facts of preserving our right to vote appear below:


Amendment XV of the US Constitution states:  “The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color or previous conditions of servitude. (archives.gov)


Section 5 of the Voting Rights Act “freezes election practices or procedures in certain states until the new procedures have been subjected to review, either after an administrative review by the United States Attorney General, or after a lawsuit before the United States District Court for the District of Columbia.  This means that voting changes in covered jurisdictions may not be used until that review has been obtained.” (justice.gov


Note that Section 5 applies to 9 states with a documented history of voter suppression. (see spindetective's February 1, 2013 post entitled Rigging the Election System: A GOP Voter Suppression Tactic Up for Grabs in February)



Conservative Supreme Court Justices' overall skepticism regarding our right to vote ignores  the reality of  – pre and post Election 2012 – voter suppression tactics led by state-level Tea Partied Republican legislators across the nation. (see Voting Rights Watch | The Nation link below)



The only weakness with Section 5 of the Voting Rights Act is that it doesn't cover enough states!
