US Senators have the Constitutional duty to act on any Supreme Court Justice nominee
presented by the President. They don’t
have to approve it, but they are
Constitutionally-bound to act on it.
On March 16,
2016 President Obama put forth the nomination of Merrick Garland to the US
Senate after the untimely death of conservative
Supreme Court Justice Scalia - Mitch McConnell
and his Republican cohorts refused to act on it!
Get this….
They refused to act on the very same nominee they all
glowingly praised and, unanimously, approved for Chief Judge
of the United States Court of Appeals for the District of Columbia!?!?!
Republican US Senators'
inexcusable excuse for not acting on
Garland’s nomination is the claim that
action on the nomination must wait until after the 2016 General Election!
That’s an outright
lie!
Here are the facts:
- Six Justices have been confirmed in a presidential election year since 1900.
- Every nominee who was not withdrawn has received a vote within 125 days of nomination
- It will be harmful and create unsustainable uncertainty if Congress fails to act on the President's nominee
If you have any doubts regarding the extreme measures Republican Senators will take to, unconstitutionally, interfere with the Supreme
Court for political gains remember this,
Republican Senator
John McCain, publicly, boasted that Republican Senators “will block all court nominations if Clinton wins”!
Bottom line -
The two real reasons Republican Senators refuse to act on President Obama’s nomination (and everything else he has presented to them throughout the past 7+ years) are:

The two real reasons Republican Senators refuse to act on President Obama’s nomination (and everything else he has presented to them throughout the past 7+ years) are:
- President Obama isn’t waving a musket while whistling Dixie in the middle of a cotton field, and
- They are betting that Trump will win or the election will be too close to call so that the Republican House of Representatives ends up electing your President! (See Electoral College link below.)
